Terms of service

These terms govern use of the Seafarerops website. Use of the Seafarerops application itself is governed by the master services agreement, order form and data processing agreement signed with your organisation; where those documents and these terms differ, the signed agreement prevails.
Using this website
You may use this site for lawful purposes connected with evaluating or using our services. You may not attempt to gain unauthorised access to any part of it, interfere with its operation, scrape it at a scale that degrades service for others, or use it to send unsolicited communications.
The service
Seafarerops licenses maritime operations software covering crew recruitment, crew onboarding, crew accounting, vessel reporting, ship scheduling and container management. Scope, modules, user counts and the number of crew managed are set out in the order form. Access is granted to named users within the customer organisation and may not be shared beyond it.
Customer responsibilities
- Keeping credentials confidential and managing user access promptly when staff change
- The accuracy and lawfulness of data uploaded to the service
- Holding the necessary basis to process seafarer records placed in the system
- Meeting the regulatory obligations that apply to the operation, which the software supports but does not discharge
Customer data and ownership
Customer data remains the property of the customer. Seafarerops claims no ownership over crew records, wage ledgers, reports or voyage data placed in the service. On termination, data is made available for export in an agreed format for the period stated in the signed agreement, after which it is deleted according to that agreement.
Availability, support and releases
Service levels, support hours, response targets and release practice are defined in the signed agreement. Released artefacts are code-signed. The vessel-side runtime is designed to continue operating during loss of connectivity; shore-side availability commitments do not extend to the customer's own satellite or shore network provision.
Fees
Commercial terms follow the model described on our engagement and pricing page: a fixed cost for assessment and deployment, and a variable cost based on the number of users and the number of crew members managed, or a customised model where agreed. Payment terms, currency, taxes and adjustment mechanics are set out in the order form.
Intellectual property
The software, documentation, interfaces and all related intellectual property remain the property of Seafarerops and its licensors. Nothing in these terms transfers ownership. Feedback you provide may be used to improve the product without obligation, and will not be attributed to you or your organisation without permission.
Confidentiality
Each party protects the other's confidential information with at least the care it applies to its own, and uses it only for purposes connected with the engagement. Customer identities are not published without written consent, which is why the case studies on this site are anonymised.
Warranties and disclaimers
We warrant that the service will be provided with reasonable skill and care and will materially conform to its documentation. Beyond that, and to the extent the law allows, the website and its content are provided as is. Content on this site is general information about our products and does not constitute regulatory, legal or classification advice.
Limitation of liability
To the extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, loss of anticipated savings or loss of business opportunity. Aggregate liability is capped as set out in the signed agreement. Nothing limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded.
Term and termination
Term, renewal, notice periods and the consequences of termination are set out in the signed agreement. We may suspend website access where use breaches these terms.
Governing law
These website terms are governed by the laws of India, with the courts of India having jurisdiction, unless a signed agreement with your organisation specifies otherwise for the service itself.
